Topic: The adaption of China's maritime arbitration system to international legal norms and practice

Presenter: Yan Xuan, PhD Candidate, TC Beirne School of Law

Shipping is the lifeline of the Chinese economy. China has become increasingly engaged in world-wide maritime activities. However, in sharp contrast with the rapid boom in shipping industry, maritime arbitration in China is facing a predicament in the practice and the academic fields. Building a native world-advanced maritime arbitration system as soon as possible to suit China's rapid developments in shipping and international trading does not permit of any delay. The object and intent of this research and thesis is to argue that through the selective adaption of the successful laws, rules and institutions from the most successful maritime arbitration centres in the World, China will be able to find its own way and build its own advanced maritime arbitration system. The thesis separately analyses the five selected maritime arbitration systems, namely, London, New York, Singapore, Hong Kong and China. Through comparative legal analysis of the gaps between China's maritime arbitration developments and the world advanced maritime arbitration systems, the thesis will improve maritime arbitration in China as so much of the world's shipping now relates to China.
