The Native Title Act - the first 25 years - Old and New Challenges

Philip Hunter has assisted and advised native title representative bodies, native title holders, native title claimants, proponents and Commonwealth and State government agencies on native title and cultural heritage law since 1994.  Mr Hunter has been involved in many high profile native title cases, including acting for the Wik Peoples and the Waanyi Peoples in their successful High Court appeals.  Mr Hunter has assisted in the negotiation of numerous consent determinations of native title and indigenous land use agreements, native title agreements and cultural heritage management plans and agreements for major resource and infrastructure projects. 

Mr Hunter undertook for the first Ministerial investigation of a native title representative body under the Native Title Act and was a member of the Commonwealth Attorney-General’s and the Minister for Indigenous Affairs’ Native Title Payments Working Group whose report to government on leading policy and practice to optimise financial and non-financial benefits from native title resource agreements resulted in the release of a discussion paper by the Australian Government entitled “Optimising Benefits from Native Title Agreements”.

Mr Hunter has been recognised as a leading lawyer in Native Title Law by Chambers Global (2015, 2016 and 2017) and was named as the ‘Market Leader’ and ‘Pre-eminent’ in Native Title Law by Doyle’s Guide (2016, 2017 and 2018).  Mr Hunter has been named one of the ‘Most Highly Regarded’ lawyers in native title law in the 2017 edition of Who’s Who Legal - Australia for Native Title.

The Richard Cooper Memorial Lecture is a joint initiative of the TC Beirne School of Law and the Federal Court of Australia. The series was established in 2005 in honour of the late Justice Richard Cooper of the Federal Court of Australia, who passed away suddenly on 14 March 2005. It is dedicated to the strong interests in maritime and native title law which he developed over the course of a long and distinguished legal career.
